01 Acceptance
By creating an account or using the TuGymPR mobile or web app (the "Service"), you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service. The Service is operated by TuGymPR ("we", "us"), based in Puerto Rico.
02 The B2B model
TuGymPR is licensed to gyms ("Gyms"), who provide it to their members ("Members") at no charge. We do not sell anything to Members; there are no in-app purchases or consumer subscriptions. Your Gym controls your membership and may add, suspend, or remove your access.
03 Eligibility / age
You must be at least 13 years old (or 16 in jurisdictions that require it, e.g., parts of the EU) to use the Service. By using it you confirm you meet the minimum age for your location.
04 Accounts
You're responsible for your credentials and for activity under your account. Provide accurate information and keep it current. Notify us of any unauthorized use.
05 License
We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial fitness purposes within your Gym's program. You may not copy, resell, reverse-engineer, or build a competing product from the Service.
06 Acceptable use & user content
You may post workouts, comments, messages, photos, and profile content ("User Content"). You retain ownership; you grant TuGymPR and your Gym a license to host and display it to operate the Service. There is zero tolerance for objectionable content or abusive behavior — no harassment, hate speech, threats, sexual content, illegal content, impersonation, or spam. We provide in-app report, block, and hide tools, and we review reported objectionable content and act within 24 hours (remove content, suspend or remove offenders, notify the Gym). We may remove content or suspend accounts that violate these Terms.
07 Health & fitness disclaimer
TuGymPR provides general fitness and nutrition information and tools. It is not medical advice and is not a substitute for a physician, dietitian, or qualified professional. Consult a doctor before starting any exercise or nutrition program. AI-generated suggestions (workouts, macros, photo analysis) are estimates and may be inaccurate. You exercise at your own risk and assume responsibility for your health decisions.
08 Rewards & points
Points and rewards are a loyalty feature run by your Gym. They have no cash value, cannot be exchanged for money, and may be changed or discontinued at any time. See your Gym's rewards terms.
09 Third-party services
The Service runs on and integrates third parties (e.g., Apple, Google, Supabase, OpenAI, payment/health platforms). Your use of those is also governed by their terms. We're not responsible for third-party services.
10 Intellectual property
The Service, excluding User Content and Gym branding, is owned by TuGymPR and protected by law. Gym names, logos, and colors belong to the respective Gyms.
11 Privacy
Your use is also governed by our Privacy Policy, including how we handle health data, photos, and AI processing.
12 Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. We don't warrant it will be uninterrupted, error-free, or that data will never be lost.
13 Limitation of liability
To the maximum extent permitted by law, TuGymPR is not liable for indirect, incidental, special, or consequential damages, or for any injury, data loss, or losses arising from use of the Service. Because Members use the Service at no charge, our total aggregate liability to you is limited to USD $100.
14 Indemnification
You agree to indemnify TuGymPR against claims arising from your User Content or your violation of these Terms or law.
15 Termination
You may stop using the Service and delete your account anytime (in-app or at /eliminar-cuenta). We or your Gym may suspend or terminate access for violations or to comply with law.
16 Changes
We may update these Terms; material changes will be announced in-app and/or by email at least 30 days before taking effect. Continued use means acceptance.
17 Governing law
These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable U.S. federal law, without regard to conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the courts located in Puerto Rico, unless applicable law gives you the right to a different venue.
18 Apple App Store EULA terms
If you downloaded from the Apple App Store: these Terms are between you and TuGymPR, not Apple; Apple has no obligation to support the app; Apple is a third-party beneficiary of these Terms and may enforce them; you confirm you're not in a U.S.-embargoed country or on a prohibited-parties list. (Standard Apple Schedule 1 EULA terms.)
